Please read these Terms of Service ("Terms") carefully before using the mobile application My Premises ("App") owned and by Stewartium LLC ("Company," "we," "us," or "our") and operated by Billdeo. These Terms govern your access to and use of the App, including any content, functionality, and services offered on or through the App.

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not download, install, or use the App.

2.1 Eligibility

You must be at least 16 years old or the legal age of majority in your jurisdiction to use this App. If you are using the App on behalf of an organization, you confirm that you have the authority to bind that organization to these Terms.

To access certain features of the App, you may need to register for an account. When registering, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Secure and protect your account credentials
• Accept responsibility for all activities under your account

2.3 Account Security

You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

• Introduce any viruses, malware, or any code of a destructive nature
• Impersonate or attempt to impersonate the Company or any employee
• Share another person's password or account information

4.2 User Content

If you submit any content to the App, you retain ownership of that content but grant us a non-exclusive, royalty-free license to use, display, and store your content for the purpose of providing the App services.

4.3 Intellectual Property

The App and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio) are owned by the Company and are protected by Jamaican and international copyright, trademark, and other intellectual property laws.

6. Payment and Billing

All payments are non-refundable except as required by law or as explicitly stated in our refund policy.

The Company owns and retains all rights, title, and interest in and to the App, including all intellectual property rights. You are granted a limited, non-exclusive, non-transferable, revocable license to download and use the App for personal, non-commercial use in accordance with these Terms.

You may not:

• Copy, modify, or create derivative works from the App
• Decompile, reverse engineer, or attempt to extract the source code
• Remove any proprietary notices or labels on the App
• Rent, lease, lend, sell, redistribute, or sublicense the App

The App may contain links to third-party websites or services that are not owned or controlled by the Company. We have no control over and assume no responsibility for the content, policies, or practices of any third-party websites or services.

8.2 App Stores

The App is available through Google Play Store and Apple App Store. Your use of the App may also be subject to the terms and conditions of these platform providers.

9. Data Protection and Security

9.1 Data Collection

We collect information as described in our Privacy Policy. You agree to provide accurate information and update it as necessary.

9.2 Data Security

The Company implements reasonable security measures to protect your personal information. However, no method of transmission over electronic networks is 100% secure, and we cannot guarantee absolute security.

9.3 Jamaican Data Protection

We comply with the Data Protection Act, 2021 of Jamaica in handling your personal information.

10. Disclaimers and Limitation of Liability

10.1 No Warranty

The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied. To the fullest extent permissible under applicable law, we disclaim all warranties, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Warranties regarding accuracy or completeness of content
• Warranties of non-infringement or technical accuracy
• Warranties that defects will be corrected

10.2 Limitation of Liability

To the fullest extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, data, use, or goodwill
• Service interruption or unavailability
• Computer failure or malfunction
• Any personal, physical, or property damages

Our total liability to you for any claim shall not exceed the amount you paid to us, if any, for using the App or $100 USD, whichever is greater.

11. Termination

11.1 By You

You may stop using the App at any time. You may also request account termination by contacting us through the contact information provided below.

11.2 By Us

We may terminate or suspend your account and access to the App immediately, without prior notice or liability, for any reason, including:

• Breach of these Terms
• Violation of any applicable law or regulation
• Abuse of the App or harmful conduct
• Request by law enforcement or governmental agency

11.3 Effect of Termination

Upon termination, your right to use the App will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including intellectual property rights, disclaimers, and limitation of liability.

12. Modifications to the App and Terms

12.1 App Modifications

We reserve the right to modify, suspend, or discontinue any aspect of the App at any time. We may also impose limits on certain features or restrict your access to parts or all of the App without notice or liability.

12.2 Terms Modifications

We may update these Terms from time to time. The updated version will indicate a new "Last Updated" date. If we make material changes, we will notify you through the App or by other means.

Your continued use of the App after any changes constitutes acceptance of the updated Terms.

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Jamaica, without regard to its conflict of law provisions.

13.2 Jurisdiction

You agree that any dispute arising from these Terms or your use of the App shall be resolved exclusively in the courts of Kingston, Jamaica.

13.3 Dispute Resolution

Before filing a claim, you agree to first attempt to resolve any dispute through good faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in Kingston, Jamaica, in accordance with Jamaican arbitration laws.

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and the Company regarding your use of the App.

14.2 Severability

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

14.3 Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of any such term or any other term.

14.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.

14.5 Force Majeure

We shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, or internet failures.

16. Acknowledgment

BY DOWNLOADING, INSTALLING, OR USING THE APP, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS OF SERVICE AND TO BE LEGALLY BOUND BY THEM.

If you do not agree to these Terms, do not download, install, or use the App.
